Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and TMRW MADE LTD ("PurgeOps", "we", "us") for use of the PurgeOps web application and related services (the "Service"). By creating an account, connecting an AWS account, or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

PurgeOps is an autonomous AWS cost-optimization agent. After you grant access through a customer-provisioned IAM role, the Service inventories resources, analyzes utilization and cost signals (including data from AWS APIs such as Cost Explorer where permitted), classifies findings by risk, and — depending on your plan and settings — recommends or performs cleanup actions on your AWS infrastructure (for example terminating idle EC2 instances, deleting unattached EBS volumes, or deleting unused load balancers).

The Service includes dashboards, findings workflows, optional Slack notifications, and an in-product agent chat. Features vary by plan tier as described on the Plan page and in your subscription.

Fair Use Policy. Certain plans, including the Scale plan, advertise unlimited on-demand scans. This is subject to fair, non-abusive use. PurgeOps reserves the right to apply reasonable rate limits to any account whose usage significantly exceeds typical customer patterns, in order to protect service quality and platform stability for all customers. Affected customers will be notified and offered options to accommodate sustained high-volume usage.

IAM role model. You grant PurgeOps access by deploying a scoped IAM role in your AWS account(s) and registering the role ARN and external ID with PurgeOps. PurgeOps does not ask for or store long-lived AWS access keys or secret keys. Access is obtained through short-lived credentials via STS AssumeRole, subject to the permissions you attach to that role.

Tiered execution. You acknowledge that:

• Low-risk findings (as classified by PurgeOps) may execute automatically when you enable auto-approve or equivalent settings.
• Medium- and high-risk findings require your explicit approval (in the product, via Slack where configured, or through other supported approval flows) before execution.
• Some resource types may never be auto-executed and may require manual handling.

You remain solely responsible for actions taken in your AWS accounts, whether initiated by you, your users, or the Service under settings you configure.

Where technically feasible for a given action type, PurgeOps attempts to create a pre-action recovery artifact in your AWS account before destructive changes — for example an AMI before EC2 instance termination, or an EBS snapshot before volume deletion. For some resource types (such as Application Load Balancers), PurgeOps may record configuration metadata rather than a full point-in-time restore image.

No guarantee of recovery. Recovery artifacts are created in your AWS account under your billing and retention policies. PurgeOps does not guarantee that any action is fully reversible, that recovery will succeed, or that artifacts will remain available for any particular period. Deleted resources without a successful snapshot or AMI (including failures during snapshot creation) may be permanently lost. You are responsible for verifying backups and retention in AWS.

• Provision and maintain IAM roles with permissions appropriate to your risk tolerance; overly broad roles increase blast radius.
• Review auto-approve and risk-tier settings regularly, especially after organizational or infrastructure changes.
• Review findings and approvals before authorizing medium- and high-risk actions.
• Ensure you have legal authority over connected AWS accounts and data processed through the Service.
• Keep your PurgeOps login credentials secure and notify us promptly of suspected unauthorized access.
• Maintain accurate billing and contact information.

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code or models except where prohibited restrictions cannot be waived by law.
• Resell, sublicense, or provide unauthorized third-party access to the Service.
• Probe or attack the Service, interfere with other users, or upload malicious content.
• Use the Service in violation of applicable law, AWS policies, or third-party rights.
• Misrepresent your identity or affiliation when using the Service.

Starter (usage-based). On the Starter tier, fees are calculated as a percentage of realized savings attributable to approved or executed findings, as shown on your Plan page and fee breakdown (currently 25% of documented monthly savings from executed purges unless otherwise agreed in writing). Methodology is based on before/after monthly cost figures recorded for executed findings in the product.

Growth and Scale. Paid subscriptions are billed in advance through Stripe on a monthly or annual cycle you select. Plan changes may be prorated by Stripe when you upgrade or downgrade mid-cycle. Taxes may apply. You authorize Stripe to charge your payment method for recurring fees until you cancel.

Cancellation. You may cancel a subscription through the Stripe customer portal or by contacting us. Cancellation typically takes effect at the end of the current billing period unless otherwise stated at checkout. We do not provide refunds except where required by applicable law.

Failure to pay may result in suspension of paid features. Starter usage fees remain due for savings realized during periods when the Service was used.

The Service is provided on a best-effort basis. PurgeOps does not offer a service-level agreement (SLA) or uptime guarantee in this version of the product. Maintenance, outages, or third-party failures (including AWS, Stripe, or hosting providers) may interrupt access. We may change or discontinue features with reasonable notice where practicable.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURGEOPS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT FINDINGS, SAVINGS ESTIMATES, OR ACTIONS WILL BE ERROR-FREE, COMPLETE, OR SUITABLE FOR YOUR ENVIRONMENT.

To the maximum extent permitted by law, neither PurgeOps nor its directors, employees, or affiliates shall be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption, arising from or related to the Service or actions taken on your infrastructure — even if we have been advised of the possibility of such damages.

Our aggregate liability for all claims arising out of or relating to the Service in any twelve-month period is limited to the greater of (a) the fees you paid to PurgeOps for the Service in that period, or (b) one hundred pounds sterling (£100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or for gross negligence where such exclusion would be unlawful.

You may stop using the Service and request account closure at any time via the Contact page or by email. You should revoke the PurgeOps IAM role in AWS when you no longer use the Service.

We may suspend or terminate your access immediately if you breach these Terms, pose a security risk, or use the Service unlawfully. We may discontinue the Service with notice where reasonable. Provisions that by their nature should survive (including liability limits, governing law, and disclaimers) survive termination.

We may update these Terms as the product evolves. We will post the revised Terms with a new "Last updated" date and, for material changes, provide notice via email or in-app message where appropriate. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. The courts of England and Wales have exclusive jurisdiction over disputes, subject to mandatory consumer protections in your country of residence where applicable.
